The Draft Braidwood Development Control Plan 2006 will go before Palerang Council on Thursday 9th March. The draft DCP includes all planning provisions for Braidwood and its setting including those relating to heritage and repeals or partially repeals all other existing relevant DCPs.
After the 60 days on exhibition, just 16 submissions were received. The NSW Heritage Council also made a submission, including that: "Exemptions will be granted from the need to obtain approval under Division 3 of the Heritage Act for all development except the following:
1. Demolition of heritage items listed on the LEP;
2. Development that does not comply with the DCP;
3. For land zoned 1(a): subdivision or erection or a new dwelling or structure greater than 100m2;
4. Any other application referred to the Heritage Council by Palerang Council."
Some of the changes to the draft Braidwood DCP are;
• All view corridors are to be removed except for those now identified in newly created precinct 4 of the draft DCP. The extension of the no building area on Wilson's Hill does away with the need for them in this area. To the east of Braidwood, the 100 metre approach road buffer setback and the very limited visual impact from town to these areas also render view corridors unnecessary.
• The deletion of cl 4.4 Precinct 3 – Industrial. No actual industrial precincts have been identified under this draft DCP. It is the intention to examine all industrial land requirements in the comprehensive review of the Palerang LEP and accompanying DCPs.
• The creation of an additional precinct for the Braidwood Heights subdivision and adjoining vacant land incorporating the development requirements approved by Council in the development consent for this areas.
• The extension of the 100 metre buffer zone to the south and east of the newly created precinct 4. The affected landowners have been contacted and indicated verbal agreement to the extension of the buffer zone subject to the removal of the view corridors over the land.
• The requirement for applicants to accompany their development applications with a Heritage Impact Statement for heritage listed items.
The Business Paper continues that "Council has been advised that delegations may be granted to Council that will remove the need for referral to the Heritage Office, depending on the heritage provisions contained in the new DCP. The tentative delegations have been provided in the Heritage Council's letter detailed above. Whatever the final delegations may be will remain unknown to Council until the Minister decides to heritage list Braidwood and then to the delegations recommended by the Heritage Council."
