If you accept the evidence at Griffin’s trial, he held the horses while Tom Clarke and Bill Scott did the shooting.
Many people at the time thought the Clarkes should have been tried for the murder of the special police but the way it worked was that the Government only needed a conviction for one capital offence to put Tom and John Clarke to death by hanging.
They chose the easiest to prove, shooting Constable Walsh at their capture. Once found guilty and hanged, there was no need to pursue their possible further crimes. In fact, they were never tried for any robberies for that matter.
This was not an uncommon way of dealing with multiple offenders. Ned Kelly was only tried for killing one of the police at Stringybark Creek, although another two died in the same encounter.
Both Manning Clarke and author John O’Sullivan say Thomas and John and John Clarke murdered the special police.
Braidwood & District Historical Society have not said such a thing.
Ms Lawson has taken some statements out of context and is now claiming the parties concerned ‘have been instructed legally’.
If she is going to try to set the record straight, she should not fire from the hip. She needs to get her facts right.
The Clarkes were tried for shooting Constable Walsh but they were never tried for shooting Sir Watkin, the tracker, as she claims.
